Over the past year, the Architectural Review Committee (ARC) has received numerous requests from Property Owners to remove a tree, most of which have been approved. However, there has been an inordinate number of trees removed without approval. In one instance an older healthy tree was removed after the ARC denied the request. Our Covenants, Conditions, and Restrictions (CCRs) state, in part, that Property Owners that remove trees without ARC approval are subject to a fine in an amount determined by the Association and in no event shall be less than $500. As such, in an effort to curtail violations, the Board has adopted the following policy.
In the event a Property Owner removes any tree(s) without the approval of the Architectural Review Committee (ARC), such Property Owner shall pay to the Association a fine of $1,500 OR if a Property Owner removes any tree(s) after approval is denied by the ARC, such Property Owner shall pay to the Association a fine of $2,500.
